PORTA POTTY RENTAL LLC – RENTAL AND SERVICE AGREEMENT
This Rental and Service Agreement (“Agreement”) is entered into between Porta Potty Rental LLC (“PPR”) and the undersigned customer (“Customer”). This Agreement must be executed prior to delivery. By signing, Customer acknowledges and agrees to the following terms and conditions.
Scope of Services. PPR will arrange the delivery, rental, servicing, relocation, and pickup of portable toilets and handwash stations (“Equipment”). All services are coordinated exclusively by PPR. Customer contracts with PPR as a single point of contact for rentals throughout the State of Arizona.
1. Delivery, Placement, and Relocation. PPR does not guarantee exact delivery or pickup times, all delivery and pickup times remain estimates only and may occur at any point during normal operating hours. Equipment must be placed on safe, level ground, accessible within 15 feet by service trucks. Equipment cannot be placed in locations requiring stairs, narrow gates, or sidewalks, or where placement may cause hazards. Customer may recommend a preferred location for Equipment placement; however, final placement shall be determined by PPR based on safety, accessibility for service vehicles, and operational requirements. Relocation after delivery is subject to additional charges and must be performed by PPR. If customer cancels order before delivery, delivery and pickup fees will not be refunded.
2. Service Frequency and cleanings. Service cleanings are performed Monday through Friday between 6:00 a.m. and 5:00 p.m., at PPR’s discretion. No specific day or time is guaranteed, but PPR will perform one (1) service visit during each calendar week. Customer must leave 15 feet of clearance for PPR vehicles to service the rental equipment. Rental equipment must be open and free to access by PPR employees. PPR will remove waste and restock the bathroom. There are two service options available:
Weekly Service: one cleaning per calendar week, four total cleanings per 28 day billing cycle
Every-Other-Week Service: one cleaning per every other calendar week, two total cleanings per 28 day billing cycle.
3. Service Attempts and Access. If PPR arrives during the scheduled week and cannot access the unit due to locked gates, missing codes, blocked access, unsafe site conditions, or other obstructions, the service will be recorded as “attempted.” Photographic and written documentation will be retained. An attempted service is considered complete for billing and service frequency purposes, and no return visit will be made until the next scheduled service date unless the Customer orders a one-time paid cleaning. It is the Customer’s sole responsibility to ensure continuous, safe, and legal access to the Equipment. PPR staff reviews every service and will try to resolve any site issues that prevent future service.
4. Service Changes and Management. All service frequency changes, additional service requests, pickups, or unit additions must be submitted through PPR’s Job Site Management Tool, which is provided to the Customer at the commencement of the rental and sent by email. If the Customer requests a change to their service frequency the change will not be made until the start of the next billing cycle.
5. Pick up of rental equipment. It is the responsibility of the customer to request a pick up date, if none is chosen the rental will continue until a pick up date is selected. Once the date of pick up is requsted by customer PPR will schedule the collection and stop billing the selected equipment on the pick up date selected.
6. OSHA Disclaimer and Capacity Recommendation. PPR provides the quantity and frequency of Equipment service ordered by the Customer. Compliance with all OSHA or other applicable sanitation requirements is the sole responsibility of the Customer. While OSHA has no single fixed standard, PPR recommends servicing one portable toilet for every 800 labor hours. As an example, ten workers performing 40 hours per week for two weeks equals 800 labor hours, sufficient for one toilet at every-other-week service. If Customer orders fewer units or less frequent service than recommended, PPR bears no liability for complaints, fines, or unsanitary conditions.
7. Acceptable Use of Equipment. Portable toilets are for human waste and PPR-supplied toilet paper only. The following materials are strictly prohibited: hazardous materials, oils, fuels, chemicals, scrap metal, electronics, batteries, or any other toxic substances into the waste tanks of the bathroom. Any prohibited items found will result in a minimum $250 fee. If hazardous waste or prohibited materials require specialized handling or remediation, the full cost of such work will be the responsibility of the customer.
8. Customer Responsibility and Risk of Loss. All Equipment remains the property of PPR or its service providers. The Customer assumes full responsibility for theft, vandalism, loss, or damage from the time of delivery until pickup. No damage waiver is available for PPR rentals. Replacement costs are:

9. Pricing and Payment. Rental and service charges are billed in recurring 28 day billing cycles. By signing this Agreement, Customer authorizes PPR to automatically charge the payment method provided on file for the full rental balance at the start of each billing cycle until Equipment is requested to be picked up and the Agreement is terminated. All billing cycles are charged in advance. Rental periods are not prorated, and unused days will not be refunded if equipment is picked up before the end of a billing cycle. If a payment attempt fails or a balance remains unpaid, PPR may suspend service. Invoices unpaid for more than three (3) days may result in Equipment retrieval without further notice. PPR reserves the right to adjust rental rates with 28 day written notice to customers.
10. Limitation of Liability. PPR is not liable for damage to pavements, surfaces, landscaping, or property resulting from delivery, service, or pickup. PPR is not liable for service delays caused by inaccessibility, unsafe conditions, or Customer instructions. In no event shall PPR be liable for indirect, incidental, or consequential damages, including lost profits or project delays. Customer personnel and equipment must remain at least 10 feet from service trucks during operation.
11. Termination. PPR may terminate this Agreement immediately for hazardous waste violations, repeated inaccessibility preventing service, non-payment, or unsafe site conditions.
12. Entire Agreement. This Agreement constitutes the complete and exclusive agreement between the parties, superseding all prior discussions or understandings, whether written or oral. Modifications must be in writing and signed by both parties.
13. Customer Acknowledgment. The undersigned represents and warrants they are authorized to execute this Agreement, have read and understood all terms, and agree to be personally and financially responsible for all charges incurred.
